2. Online Store Terms

By placing an order through our store, you confirm that:

  • your use of the site and your purchase of products comply with applicable law

3. Product Information and Availability

We make every effort to display product descriptions, mockups, colors, and images as accurately as possible. However, we do not guarantee that product colors, print placement, texture, or appearance on your screen will be exactly the same as the final printed product.

Because our products are made to order through a third-party fulfillment partner, product availability, fulfillment times, and shipping times may change without notice.

4. Print-on-Demand Fulfillment

Our products are made to order through Printful. By purchasing from our store, you understand that items are produced after an order is placed, rather than kept as pre-made inventory.

We are responsible for the operation of our store and the content we upload for sale, while Printful applies its own platform terms and intellectual property rules to files submitted for production. Shopify states merchants are responsible for the materials they upload and the operation of their store, and Printful states sellers are responsible for uploaded content and must have the rights to use and sell it.

5. Pricing, Billing, and Order Acceptance

All prices are listed in [currency] unless otherwise stated. We reserve the right to change prices at any time without notice.

We reserve the right to refuse, limit, or cancel any order at our sole discretion, including orders that appear fraudulent, unauthorized, or connected to resale abuse, pricing errors, or suspected violations of our policies.

If we cancel or modify an order after it has been placed, we may attempt to notify you using the email address or contact information provided at checkout.

6. Accuracy of Information

You agree to provide current, complete, and accurate purchase and account information for all orders placed at our store. You agree to promptly update your information, including email address, billing details, and shipping address, so we can complete your transactions and contact you as needed.

We are not responsible for delays, failed deliveries, or additional charges caused by inaccurate, incomplete, or outdated customer information.

7. Returns, Refunds, and Exchanges

All return, refund, replacement, and exchange requests are governed by our posted Return Policy and Shipping Policy, which are incorporated into these Terms by reference.

Because items are made to order, we generally do not accept returns or exchanges for buyer’s remorse, incorrect size selection, or change of mind, except where required by law.

8. Intellectual Property

All content on this site, including but not limited to:

  • artwork
  • graphics
  • product designs
  • logos
  • branding
  • business names
  • text
  • product photos
  • mockups we created
  • website content and layout

is the property of The Spicy Cafe or its licensors and is protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, modify, republish, sell, exploit, or use any part of our designs, branding, product listings, images, or content without our prior written permission.

This includes using our content for:

  • resale
  • reproduction on other products
  • commercial use
  • social media business use without permission
  • training, scraping, or extracting designs or listings for competing commercial purposes

This section is especially important for a POD store because Printful prohibits infringing use of third-party intellectual property, and Shopify can remove content that violates intellectual property rights.

9. Limited License

We grant you a limited, revocable, non-transferable license to access and use this website for personal, non-commercial shopping purposes only.

This license does not include any right to:

  • reproduce our designs or store content
  • download product images for commercial reuse
  • copy product descriptions
  • mirror or frame our website
  • use data mining, bots, scraping tools, or similar extraction methods
  • use our trademarks, logos, or branding in a misleading or unauthorized way

10. User Submissions and Feedback

If you send us comments, reviews, suggestions, testimonials, ideas, or other submissions, you agree that we may use, edit, publish, and share them in connection with our business, unless otherwise agreed in writing.

You agree not to submit anything unlawful, abusive, defamatory, misleading, infringing, or otherwise harmful.

If you submit custom content, names, phrases, or artwork for any reason, you represent that you own it or have the legal right to use it.

Both Shopify and Printful prohibit unlawful and infringing content or activity on their platforms, so this kind of clause is worth keeping in your store terms.

Our store may use third-party platforms and services, including Shopify and Printful, to process payments, host the storefront, and fulfill orders. We are not responsible for outages, interruptions, policy changes, or service limitations caused by third-party providers.

Your use of those third-party services may also be subject to their separate terms and policies.

To the fullest extent permitted by law, our site and all products and services are provided on an “as is” and “as available” basis without warranties of any kind, express or implied.

We do not guarantee that:

  • the website will be uninterrupted, timely, secure, or error-free
  • product mockups will appear exactly the same as printed items
  • shipping carriers will deliver within estimated timelines
  • all errors on the site will be corrected immediately

14. Limitation of Liability

To the fullest extent permitted by law, The Spicy Cafe, its owner(s), affiliates, service providers, contractors, and partners shall not be liable for any indirect, incidental, special, punitive, or consequential damages arising from your use of the site or purchase of products.

Our total liability for any claim relating to a product or order shall not exceed the amount you paid for the specific product giving rise to the claim, except where prohibited by law.

15. Indemnification

You agree to indemnify, defend, and hold harmless The Spicy Cafe and its affiliates, partners, contractors, service providers, and representatives from any claim, demand, loss, liability, or expense arising out of:
